The Advocacy Team for Democracy (TAUD), acting as legal counsel for Andrie Yunus, emphasized that their client has decided not to testify in the trial at the II-08 Military Court in Jakarta. This step was taken as a motion of no confidence in the objectivity of the judiciary currently trying four members of BAIS TNI regarding an acid attack case against Andrie.
Deputy Coordinator of KontraS, Afif Abdul Qoyim, stated that this stance is not an attempt to evade legal responsibility. On the contrary, it represents a political struggle to demand more substantive justice for victims of violence by military personnel.
The legal counsel also highlighted the behavior of the Chief Judge, Fredy Ferdian Isnartanto, which was considered intimidating as he threatened forced retrieval and criminal charges. TAUD assessed that the threat used an irrelevant legal basis, namely Article 285 of the Criminal Code (KUHP), which is designed specifically for civilian courts, not military courts.
Furthermore, the advocacy team condemned the legal logic used by the court. According to them, the threat of forced retrieval against Andrie demonstrates a flawed perspective by the court, treating a civilian as if they were a military member committing desertion, even though Andrie's status in this case is that of a victim.
